2.04 Damage or Destruction of Common Area by Owner

In the event any Common Area is damaged or destroyed by an Owner, their tenants, guests, licensees, agents, or members of their family, the Association may repair such damage at the Owner’s expense.  The Association may repair such damage in a good and workmanlike manner in conformance with the original plans and specifications of the Common Area involved, or as the Common Area may have been modified or altered, or as otherwise determined by the Board, in the sole discretion of the Board of Directors.  The cost of such repairs shall become an Individual Assessment, as described more particularly in Section 4.8 herein, upon the Lot of such Owner and shall constitute a lien upon such Owner’s Lot and be collectible in the same manner as other assessments set forth in Article IV herein.
