4.08 Individual Assessments

Individual Assessments shall be those expenses directly related to maintenance, or a service provided, to one or more Lots, whether at the request of the Owner thereof or as a result of an Association obligation under the Governing Documents or by law or for an expense of the Association benefitting the Lot; or as an exercise of an Association remedy, as set forth in Article XI herein, and shall further include violation charges levied pursuant to the Governing Documents and Va. Code Ann. § 55.1-1819. If an Individual Assessment is levied on multiple Lots owned by one Owner it shall be allocated among that Owner’s Lots as the Board of Directors directs or, in the absence of such direction, equally among such Lots.  Notwithstanding the concept of Individual Assessments, the Association is not obligated to provide any service or maintenance to Lots except as expressly provided in the Governing Documents.
