4.13 Subordination of the Lien to Mortgages

The lien of Assessments shall be subordinate to the lien of any prior mortgage or deed of trust. Sale or transfer of any Lot shall not affect the lien. However, the sale or transfer of any Lot by foreclosure of a prior mortgage or deed of trust, shall extinguish the lien of such charges as to payments which become due prior to such sale or transfer, provided that there is no surplus from the sale to pay the lien in full or in part. No sale or transfer shall relieve such Lot from liability for any Assessments thereafter becoming due or from the lien thereof, and any personal liability for the Assessments shall not be extinguished by foreclosure.
