5.13 Single Family Residential

Only single-family dwellings and accessory buildings, complementary to the Dwelling Unit, shall be permitted on any Lot, which is designated as Single Family Residential. The following restrictions shall specifically apply to such Lots unless it is otherwise provided in a Supplemental Declaration:

(a)        Minimum Area.  Each Dwelling Unit shall have a fully enclosed floor area, exclusive of roofed or unroofed porches, terraces, garages, carports or other accessory buildings, with not less than the number of square feet established in the Supplemental Declaration for the section or unit in which the Lot is located. Any area, which is wholly or substantially below ground level, shall not be included in the calculation of square footage unless approved by the ARC.

(b)       Setback Lines.  Except as otherwise provided in a Supplemental Declaration, each such Dwelling Unit shall be at least: (a) Thirty feet (30’) from the front Lot line; (b) Twenty-five feet (25’) or Twenty-five percent (25%) of the depth of the Lot, whichever is greater, from the rear Lot line; and (c) Ten feet (10’) from the side Lot lines.  In the event the ARC shall determine that application of the aforesaid setback lines to a particular Lot would unreasonably limit the use of the Lot by the Owner, and effectively deprive them of an appropriate building envelope on the Lot, the ARC may grant a variance to the Owner of said Lot from the foregoing setback requirements.
