12.01 Limitation of Liability

To the extent that the Association, its Board or any of its committees undertake certain voluntary functions to enhance the quality of life in Ford’s Colony at Williamsburg, including, but not limited to (i) implementing plans to make Ford’s Colony at Williamsburg safer or maintaining lists of those who need assistance in the event of disasters; or (ii) performing other services to enhance the safety, health and welfare of its Owners, or (iii) coordinating clubs and groups, and social functions, such undertaking(s) shall not create a duty on the Association to perform such functions and the Association, its Board, its committees, and its Members shall have no liability whatsoever in the event that it does not perform the aforesaid functions and the Association, its Board, its committees, and its Members shall have no liability whatsoever to any Owner, Mortgagee, Contractor, occupant of a Dwelling Unit, or any other party for any costs or damages, consequential or otherwise, that may be incurred or suffered.
