12.02 Amendment by Owners

FCHOA Declaration of Protective Covenants - Revision Date: 2022-05-20

The covenants and restrictions of this Declaration shall run with and bind the land, for a term of twenty (20) years from the date this Declaration is recorded, after which time they shall be automatically extended for successive periods of ten (10) years. This Declaration may be amended by approval of not less than sixty-six and two-thirds percent (66-2/3%) of the Owners who are eligible to vote during the initial term and at any time thereafter. The approval of the Owners shall be evidenced by written or electronic ballot at a duly called meeting of the Association, and the recording of the amendment, together with a certification signed by the principal officer of the Association and attested by the Secretary of the Association that the requisite majority of Owners approved the amendment. Any amendment shall be effective upon recording.
