B. General Terms of Use
FCHOA Facilities & Amenities Rules & Regulations - Revision Date: 2023-09-28
1. FCHOA members who sponsor approved events are at-all-times responsible for their guests/vendors while using the facilities, including costs for damages as determined by the ARM.
2. Smoking is prohibited within all FCHOA buildings and facility grounds. Smoking is prohibited on any common property while being used for a scheduled event or activity.
3. Firearms, weapons, or explosives of any kind, including fireworks, are prohibited at any facility, common area or grounds. (See VI. Enforcement Section)
4. Decorations may be used only with the prior approval of the Activities and Recreation Manager. Items may not be hung from the ceiling, walls, chandeliers, sconces or other attachments to the walls. Pictures hung on the walls may not be removed. Local ordinance prohibits the release of inflated balloons. Inflatable bounce houses or other play structures may not be set up without prior FCHOA approval. Approval should not be expected due to safety and liability concerns.
5. S&T Club equipment items are to be used only on S&T Club premises and are not to be removed without the permission of the ARM. Additionally, items from one facility may not be moved to the other without the permission of the ARM.
6. Items may not be left overnight in the refrigerators unless labeled with club/group name. Non-food items may be stored in cabinets in the storage closet as assigned by the ARM. No other items are to be stored in the S&T Club, except those items for a function scheduled for the next day may be stored in the locked cabinet in the kitchen or refrigerator with approval of the ARM.
7. All furniture and equipment brought into the facility must be removed immediately after the event unless other arrangements are made in advance with the Activities and Recreation Manager.
8. Personal items shall not be left in the club, pavilion, patio or within the restrooms. The FCHOA is not responsible for the loss of any items.
9. For emergencies, dial 911. A telephone is available outside the front entrance of the S&T Club building. An AED is located inside the S&T Club in the foyer on the wall. The Pickleball club maintains an AED at the courts during club play. At Westbury Park the AED is located in the pavilion area on the wall.
10. At the conclusion of any function, at or beyond the closing time of the building, Security must be notified to secure the facility by calling 757-258-4080.
11. Excessive noise will not be permitted at any time. In consideration of nearby residents, noise and music levels of outside events must be reduced no later than 9 p.m. Failure to comply with the instructions of Management Agent and/or Security regarding nuisances may result in termination of the event and/or forfeiture of deposit. Noise is prohibited after 11 p.m.
12. Except for Service, Therapy and Support Animals, or as may be authorized by the ARM with the approval of the Activities Committee, for special functions, pets are not permitted in any buildings or inside any fenced area. The Westbury Parkfield may be used to exercise, or train dogs as-long-as dogs are supervised, are on leash ["under positive voice control" was removed to meet James City County regulations October 2023], and all fecal matter is removed. Violators may be subject to monetary charges or suspension of the privilege of use of the facilities, in other FCHOA Common Areas of Ford’s Colony, dogs must be constrained on leashes and owners are responsible for cleaning up all fecal matter after their pets.
13. In the event that simultaneous scheduled events fill the parking lot to capacity, the ARM will allocate parking spaces between competing events.
14. The Activities and Recreation Manager will arrange for set-ups and breakdowns for all events. A diagram with table/chair arrangements shall be given to the ARM no-later-than 72-hours in advance. Family, Social, Private and Business, Charity and Private Outside Organization functions must pay set-up/break down fees as per Exhibits I and II.
15. Fornon-FCHOA member sponsored events, the Sponsor is responsible for obtaining any use permit or license, such as a music or video use license, or Alcoholic Beverage license, prior to the event and having such license available for inspection for up to 90 days after the event. The Sponsor is solely responsible for determining if such permits or licenses are required by law and is responsible for any financial and/or other penalties.
