A. Swimming Pools at the S&T Club and Westbury Park

FCHOA Facilities & Amenities Rules & Regulations - Revision Date: 2023-09-28


  1. Rules and Regulations


    a. Lifeguards will be on duty during specified hours from Memorial Day weekend through the Labor Day weekend and during an extended season, weather permitting.

    b. Everyone in the pool area must always follow the instructions of the lifeguards and the Activities and Recreation Manager.

    c. Everyone must adhere to all Facilities & Amenities Rules and Regulations. FCHOA members are responsible for assuring their guests’ compliance with these Rules and Regulations.

    d. Lifeguards on duty have first-aid supplies and lifesaving equipment.

    1. The S&T Club pool first-aid cabinet is in the pool pump room. The portable AED is located on the pool deck. When the pool is closed the portable AED is secured. In case of an emergency when the pool is closed, an AED is available in the S&T Club foyer. There is also a first-aid cabinet in the S&T Club on the wall in the kitchen in a clearly marked cabinet.

    2. At the Westbury Park Pavilion, an AED is located on the wall near the multi-purpose room. During pool season a portable AED is located on the pool deck. At Westbury Park a first-aid cabinet is located inside of the Lifeguard staff office on the wall, clearly marked.

    e. Lifeguards are not day care providers. For the safety and enjoyment of all, the FCHOA is following select rules adopted by James City County Parks and Recreation, as well as recommendations of the County Child Protective Services: children under the age of 12 must be directly supervised by a person 16 years or older. Any person not reasonably proficient in swimming must be directly supervised in the water and within arm’s reach by a responsible person aged 16 or older.

    f. Lifeguards are not responsible for assessing swimming ability for persons in the pool; however, a lifeguard may ask a person to leave the pool if they deem it appropriate for the person’s safety or the safety of others.

    g. Each FCHOA pool user MUST register at the podium(s) upon entering the pool area.

    h. Anyone using the S&T pool must first shower using the outside shower before entering the pool; the Westbury Park pool showers are inside the restrooms.

    i. The poolside restrooms at the S&T and Westbury pools are available for persons using the pool areas during the pool season.

    j. Persons with sores, skin disease, colds, inflamed eyes, nasal/ear discharge, or communicable diseases shall not use the pool.

    k. All guests must be accompanied by an FCHOA member. If crowding is a problem, guest privileges and/or the number of guests may be limited by the ARM or lifeguards.

    l. Children 6-years and older are not permitted in the S&T Club wading pool or to linger in the Westbury Park zero-entry wading entrance. Climbing or standing on the wading pool separation wall or lane marker is not allowed.

    m. Supervising persons, 16-years and older with infants/small children or any non-swimmer in the pool, must always be within arms-reach of those children/persons.

    n. Proper bathing suits are required in the pool and in pool deck area. Revealing bathing suits, as determined by a staff member, are not permitted; e.g., Brazilian, G-string, cheeky cut, thong, sheer, and similar revealing style bathing suits for men and women. The privilege of any person to be at the pool is conditional.

    o. Children who are not toilet-trained must wear appropriate swim wear such as disposable rubber or plastic swim pants when entering the pool. Diaper changing must be done in the poolside restroom where a changing table, soap and hot water are available. It is the responsibility of the individual or supervising person to alert lifeguards, if during swimming, swimwear tears or rips allowing leakage from swimwear into the pool.

    All others who are incontinent must take appropriate and necessary protective measures when in the pool.

    p. The Activities and Recreation Manager and/or the lifeguards are authorized to close the pool for health or safety reasons. They may reopen the pool when conditions permit.

    q. For general safety, lack of swimming ability or inappropriate behavior may result in the immediate suspension of the person’s privilege to use the pool for one or more days. Broad discretion is provided to the ARM and lifeguards on duty.

    r. Diving into the pool or running on the pool deck is not permitted.

    s. Food or beverages are not permitted in the pool or within 4-feet of the edge of the pool. Trash must be placed in waste containers.

    t. Alcoholic beverages may not be used by anyone using the pool. Section III. F.

    u. Glass containers are not permitted in the pool, pavilion, or patio areas.

    v. Chewing gum or other products, inappropriate/obscene language, spitting, spouting, or nose-blowing in the water is prohibited. Smoking is not permitted within the fenced grounds.

    w. The volume of any device shall not be audible to other patrons, unless prior approval by the ARM.

    x. Pool toys, any size floats, balls, etc., may be used only at the lifeguard's discretion. Only foam-style balls are allowed in the pool; footballs, tennis balls and such are not allowed. In consideration of others and general safety, large pool items (e.g.; rings over 24-inches, creature and recliner floats), may not be brought into the pool area. These items may not be stored at either of the recreational facilities.

    y. Pool slide rules are displayed at the slide located at Westbury Park.

    z. Water balloons are not allowed in the pools, pool deck, pavilion, and patio at either pool facility. If used on the common grounds by anyone, it is the responsibility of those with the water balloons to clean up.

    aa. Micro mobility devices may not be ridden on the pool decks, pavilion or patio and sidewalk areas at the S&T Club facility or Westbury Park. For example, bikes, electric scooters, skateboards, golf carts, kick scooters, one-wheel, roller skates, segways, unicycles, tricycles, handcycles. Bicycles need to be placed in the provided bicycle racks.

    bb. The Swim Team Board and the Activities and Recreation Manager will determine weekly Swim Team practice hours and scheduled meets. The pool will be closed to all non-team swimmers on the day of each swim meet, as determined by the ARM. Swim meets may be rescheduled due to inclement weather.

    cc. Swimming when lifeguards are not on duty is not permitted, except for members of the Swim Group Club at scheduled times, providing a supervisor and safety equipment are present and that all other requirements of the swim program are met. The Swim Group Club is defined as registered, proficient swimmers capable of a sufficient lap swim pace for group swim and is not limited by age. Waivers are required to participate.

    dd. Pets are not permitted within the pool areas (with the exception of service dogs wearing harnesses or vests). No pets are permitted in the pool.

    ee. Everyone is entitled to reasonable quiet enjoyment of the facilities. Any activity or noise causing a disruption or nuisance may be grounds for a warning and/or removal from the Club areas for the remainder of the day. Longer term suspensions will follow procedures as noted below.


    2. Enforcement of Pool Rules and Regulations


    a. Lifeguards are entrusted with the authority to enforce the Pool Rules and Regulations. Lifeguards are trained to reduce the risk of serious injury through precautionary enforcement of safety rules and direct response to emergencies. Lifeguard is a designation by the American Red Cross. Lifeguard is not a guarantor of life safety.

    Any pool usage is at one’s own risk and young children must be supervised by a parent or designated person.

    b. Safety Breaks: Lifeguards will blow a whistle each hour at a quarter-to-the-hour to indicate a safety break, usually for a duration of 15-minutes. The purpose of the break is to allow the lifeguards to change positions, test the pool water, perform any necessary maintenance or cleaning, and to refresh themselves. At the lifeguards’ discretion, consistent with their ability to monitor pool activity, persons may be permitted to continue to swim during this period if at least one lifeguard is able to be in a guard position and the level of activity in the pool is manageable by one guard.

    There will always be one lap lane available for proficient swimming pool users wishing to swim laps, except when the pool is in use for swim team practice or meets (or Safety Breaks). Members wishing to swim laps during practice or meets should use the alternate pool.

    c. Lifeguards have whistles for safety purposes and to alert people at the pool.

    ONE WHISTLE BLAST - Will be used to get the attention of a patron.

    THREE WHISTLE BLASTS - Constitutes an emergency. Everyone must immediately clear the pool and pool deck. Emergency drills on this procedure will be held periodically.

    d. FCHOA members and their guests may not interfere with lifeguard instructions, warnings, and disciplinary actions.

    e. Disregard of the Rules and Regulations or lifeguard's directions may result in the immediate suspension of the privilege to use pool facilities at the discretion of the lifeguard.

    f. The Activities and Recreation Manager or the lifeguard on duty may restrict anyone from the use of the pool or pool area if, in their opinion, the individual's presence is detrimental to the health or safety of themselves or others. Repeated misbehavior may result in the expulsion from the pool or pool area. Lifeguards have been instructed as to specific procedures to be used when dealing with misbehavior. Lifeguards shall be supported when they are enforcing pool regulations.


    3. Pool Use for Family | Social | Private Parties


    a. The S&T Club patio/terrace or the Westbury Park pavilion may be used for Family/Social/ Private Parties for a fee. (See Fee Schedule, Exhibit I). For the purposes of these rules, a family, social or private function is defined as a group larger than six (6) people. The fee includes use of the patio/terrace area or pavilion and grills. Decorations such as balloons and banners may be used if approved in advance, at the discretion of the Activities and Recreation Manager and must be removed at the end of the party. Such events, however, will not have exclusive use of the pool facilities and other FCHOA members will not be precluded from using the facilities at the same time.

    b. Family/Social/Private Parties will be restricted in size at the discretion of the ARM. FCHOA lifeguards will be required for any Family/Social/Private Parties that go beyond the normal pool hours or during normal pool hours, if the ARM believes they are necessary. Arrangements and payment for a lifeguard(s) must be made with the ARM.

    c. All other Rules and Regulations pertaining to the use of the facilities (regarding decorations, noise, alcohol, smoking, fireworks, etc.) for any Party/Function/Event will also apply. Section III. B. C. D. E. F.
